1. Our role — please read first
Thailand Boat Tours is a booking platform. It lets you design a charter and connects you with independent yacht agents, brokers and vessel owners who operate their own businesses.
Where your charter is arranged with an independent agent or third-party operator, the contract for that charter is between you and that agent/operator. Thailand Boat Tours acts only as an introducer and accepts no responsibility or liability for what you agree with them — including their prices, availability, payments, cancellations, refunds, the condition or seaworthiness of their vessel, their crew, their insurance, or the conduct of the trip.
Exception — Moby Dick: charters booked through Moby Dick agency, which is under our ownership, are contracted with us directly. For those bookings these Terms and our responsibilities as operator apply in full.
2. Quotations & bookings
A quotation is an offer, not a confirmed booking. Prices, vessels and dates remain subject to availability until the agent/operator confirms the booking in writing.
A booking becomes binding only once it is confirmed and the charter agreement is signed. Where a vessel’s availability has to be verified with its owner, confirmation is issued only after the owner confirms the vessel is free for that date.
3. Prices, payment & cancellation
Prices are quoted in Thai Baht (THB). Unless the quotation states otherwise, prices are shown including 7% Thailand VAT where VAT applies to the issuing agent.
Payment terms, deposits, cancellation deadlines and refunds are set by the agent or operator issuing your quotation and are stated in your charter agreement. Please read that agreement before signing — it governs your booking.
Charter time beyond the agreed block is chargeable at the operator’s stated overtime rate, per started hour.
4. Weather, safety & the captain’s authority
The captain has final authority on all matters of safety, navigation and the route. The itinerary you select is a plan, not a guarantee: sea state, weather, port authority instructions or national park closures may require changes, shortening, or cancellation of a trip.
Guests must follow the crew’s safety instructions and the rules on board at all times. The captain may refuse boarding to, or disembark, any person who is intoxicated, behaves unsafely, or endangers others — without refund.
5. Guest responsibilities & liability
You are responsible for the accuracy of the details you provide (names, passenger numbers, ages, dates, contact details). Errors may prevent boarding or invalidate insurance.
Guests are liable for loss or damage they cause to the vessel or its equipment. Personal belongings are brought on board at your own risk.
Travel and medical insurance is your responsibility. We strongly recommend cover that includes water-based activities.
Nothing in these Terms excludes liability that cannot be excluded under Thai law.
6. Intellectual property
This website and everything in it are the exclusive property of Thailand Boat Tours and are protected by copyright and other intellectual property laws. This includes, without limitation: the text and wording, photographs and video, logos and branding, the design, layout and look and feel, the underlying software and source code, the interactive itinerary planner and maps, the route and destination descriptions, the pricing structures and quotation documents, and the contracts and PDFs it generates.
No part of this website may be copied, reproduced, republished, downloaded for reuse, stored, transmitted, translated, adapted or otherwise exploited, in whole or in part, in any form or by any means, without our prior written permission. This expressly includes copying our text or images onto another website or social media page, cloning or imitating the design or booking flow, automated scraping or harvesting of any content or data, framing or embedding our pages within another site, and using our content to train or feed automated or AI systems.
Limited AI exception: as an exception to the paragraph above, the owner has expressly granted Anthropic and Google permission to use the publicly accessible content of this website for training their AI systems. This permission is given voluntarily by the owner, applies to those two companies only, and may be withdrawn at any time. It grants no rights to any other party.
You may view the site and print or save pages solely for your own personal, non-commercial use in connection with your own booking. No other licence or right is granted.
We monitor for copies of our site and content. Unauthorised use will be pursued, including takedown requests to the infringing party’s host, registrar and search engines, and any legal remedies available to us. All rights reserved.
7. Content, privacy & changes
Vessel details, photographs, routes and indicative timings are provided in good faith and may change. Timings shown in the planner are estimates based on cruising speed and are not guaranteed.
Personal data is handled as described in our Privacy Policy.
These Terms may be updated. The version in force is the one shown at the time of your booking.
8. Governing law
These Terms are governed by the laws of the Kingdom of Thailand, and the Thai courts have jurisdiction over any dispute.
9. The Second Mate and the shoe shop
The Second Mate. Weather, sea state, tide, radar, alert and boat-position information is provided for planning and general information only. It comes from third-party sources, may be incomplete, delayed or wrong, and is not a substitute for official forecasts and warnings, proper navigation, or the skipper’s own judgment. You use it at your own risk and remain solely responsible for the safety of your vessel and crew.
Custom painted shoe shop. Prices, delivery methods and payment methods (cash on delivery or PromptPay) are shown when you order. Please check your name, phone number and delivery address carefully; wrong details can delay or prevent delivery.
To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of these services.
